Understanding Your Pathway

The Subclass 188 Business Innovation and Investment (Provisional) visa was for business owners, investors and entrepreneurs who wanted to own and manage a business, or make a designated investment in Australia. It operated across multiple streams: Business Innovation, Investor, Significant Investor, Entrepreneur and Premium Investor. Important: the BIIP was closed to new primary EOIs from 1 July 2024. Existing 188 holders can continue their stay and transition to the permanent Subclass 888. For new applicants, the National Innovation Visa (858) and other pathways are now relevant.

Your Step-by-Step Journey

From assessment to visa grant: here's how the process works.

The BIIP closed to new primary EOIs from 1 July 2024. If you are an existing 188 holder, CMG confirms your pathway to the 888 permanent visa. If you are a new applicant, CMG maps alternative pathways including the NIV (858) or skilled migration routes.

For streams that reopened or accepted EOIs before closure: lodge an EOI in the Business and Innovation Selection (BIS) system, claiming points or meeting stream-specific requirements. Each state has separate criteria.

Apply to a state or territory government nomination program. Each has its own criteria, industry priorities, documentation requirements and fees. CMG tracks active programs and prepares nomination packages.

After nomination, the Department issues an invitation to apply. Lodge the 188 application within the specified timeframe with all financial evidence, business documents and tax records.

Complete health examinations and provide police clearances from all relevant countries. Biometrics may also be required.

During the 188 provisional period, meet the stream-specific requirements: operate your business in the nominating state (188A), maintain complying investments (188C), or execute your entrepreneur proposal (188E).

After meeting all activity requirements, lodge the Subclass 888 application for permanent residence. CMG maintains ongoing support throughout the provisional period to ensure full compliance and a successful 888 outcome.

What is the Business Innovation and Investment visa (subclass 188) and who is it designed for?

Direct answer

The Business Innovation and Investment visa (subclass 188) is a provisional visa with several streams for business owners and investors, requiring state or territory nomination and leading to permanent residence through subclass 888.

The useful starting point isn't which visa is easiest to get - it's what this one is designed to do. It suits business owners and investors with a documented ownership or investment history who are willing to be nominated by an Australian state or territory and to run or hold a qualifying business or investment in Australia.

That purpose drives the rest of the journey - the evidence you'll gather, the conditions on the grant, where you can live and work, and whether a further application will be needed down the track.

Compare the business innovation, investor and entrepreneur streams against your capital, ownership history and appetite for running a business in Australia. Subclass 188 is a provisional business and investment visa with several streams. It requires state or territory nomination and leads to permanent residence through subclass 888 once the stream's business or investment conditions have been met.

If it's granted, here's what you actually get: a provisional visa allowing you to establish, manage or hold a qualifying business or investment in Australia, leading to permanent residence through subclass 888 once the stream conditions are met.

Key points

  • Subclass and permanence: 188 (provisional) to 888 (permanent) / Provisional, then permanent
  • Sponsorship position: State or territory required
  • Outcome: A provisional visa allowing you to establish, manage or hold a qualifying business or investment in Australia, leading to permanent residence through subclass 888 once the stream conditions are met.

What are the eligibility requirements for the Business Innovation and Investment visa (subclass 188)?

Direct answer

You'll need to meet the age requirement, generally under 55 at the time of nomination, with limited exemptions, hold net business and personal assets that meet the threshold for the stream you apply under and demonstrate a successful business or investment history with documented ownership or holdings.

These aren't weighted against each other. Each requirement stands alone, so clearing four out of five still leaves the application short.

  • Meet the age requirement, generally under 55 at the time of nomination, with limited exemptions
  • Hold net business and personal assets that meet the threshold for the stream you apply under
  • Demonstrate a successful business or investment history with documented ownership or holdings
  • Obtain nomination from an Australian state or territory and meet that jurisdiction's own criteria
  • Meet the English requirement, or pay the applicable second instalment charge
  • Meet health and character requirements for every applicant included
  • Commit to the business or investment activity and settlement conditions attached to the stream

Review state or territory nomination, business turnover, net assets, ownership history, English level and age requirements before you commit capital.

Because failing a single gate makes the rest irrelevant, an early and honest assessment is worth more than a polished application built on an assumption that turns out to be wrong. Check the constraint you can least influence first.

Key points

  • Meet the age requirement, generally under 55 at the time of nomination, with limited exemptions
  • Hold net business and personal assets that meet the threshold for the stream you apply under
  • Demonstrate a successful business or investment history with documented ownership or holdings
  • Obtain nomination from an Australian state or territory and meet that jurisdiction's own criteria

Which documents and evidence support a Business Innovation and Investment visa (subclass 188) application?

Direct answer

A complete application typically requires business registration, shareholding and ownership documents for the qualifying period, audited financial statements and tax records for the business or investment and evidence of net business and personal assets, including valuations where required.

A decision maker can only assess what your file actually shows, which is why documentation is where applications are won or lost. For this visa you'll generally need:

  • Business registration, shareholding and ownership documents for the qualifying period
  • Audited financial statements and tax records for the business or investment
  • Evidence of net business and personal assets, including valuations where required
  • Source-of-funds documentation tracing each qualifying asset to a lawful origin
  • State or territory nomination approval and any jurisdiction-specific declarations
  • A business plan or investment proposal for the Australian activity
  • Passport, identity documents, police clearances and medical examination results
  • Certified translations of any documents not issued in English

Aim for coherence rather than volume. Names need to match across every document, dates need to line up between payslips, references and forms, and any translation needs certification from an approved provider. A compact file telling one consistent story beats a thick one full of contradictions - and it's far less likely to trigger a request for further information, which is the most common cause of a longer wait.

Key points

  • Business registration, shareholding and ownership documents for the qualifying period
  • Audited financial statements and tax records for the business or investment
  • Evidence of net business and personal assets, including valuations where required
  • Source-of-funds documentation tracing each qualifying asset to a lawful origin

How much does the Business Innovation and Investment visa (subclass 188) cost in total?

Direct answer

Business and investor visas carry some of the highest government charges in the migration program, and the total cost of the pathway extends well beyond the visa application charge.

Business and investor visas carry some of the highest government charges in the migration program, and the total cost of the pathway extends well beyond the visa application charge. Expect significant professional costs for audited financial statements, business valuations, forensic accounting to establish source of funds, and business plan preparation. Some jurisdictions charge a separate nomination fee, and the second instalment for English may apply. Because the pathway involves two stages, the permanent subclass 888 application attracts its own charge later. Plan the total across both stages, and confirm current figures rather than relying on historical amounts.

It helps to separate the fixed from the variable. Government charges are published and non-negotiable, and they change when the Department decides. Supporting costs vary with your situation and your decisions, and that's the part people routinely underestimate.

The reliable approach is a line-by-line budget: government charge, per-applicant charges, testing, medicals, clearances, translations and professional fees. Then add a contingency. Multi-stage pathways should be costed as a whole rather than stage by stage, because the second instalment is often the larger one.

Charges are indexed and revised, so treat every figure here as a planning guide and confirm the current schedule with the Department of Home Affairs before you pay anything.

Key points

  • Government charges are fixed, published and indexed - confirm the current schedule
  • Supporting costs vary with circumstances and are frequently underestimated
  • Multi-stage pathways should be budgeted in total, not per stage
  • Allow a contingency for repeated tests and additional clearances

How long does the Business Innovation and Investment visa (subclass 188) take to process, and what affects the timeline?

Direct answer

The nomination phase is the dominant variable, not the visa application itself.

The nomination phase is the dominant variable, not the visa application itself. Each jurisdiction opens, prioritises and closes its business migration streams independently, and many operate invitation-based or quota-limited processes. Financial evidence verification adds time on top: auditors, valuers and source-of-funds analysis all run on their own schedules. Realistically, the pathway from first enquiry to provisional grant often spans a year or more, and the permanent stage adds a further period of business or investment compliance before subclass 888 can be lodged.

There are two timelines running in parallel, and separating them is what makes planning realistic. Preparation time is the one you control: evidence, skills assessment, English testing, clearances, a complete file. Assessment time is the one you don't - it moves with application volume, the checks your case requires and where the Department has decided to focus.

Timelines depend on the stream, the nomination process and the complexity of your financial evidence. Source-of-funds documentation and audited accounts are usually the most time-consuming parts.

Where you can influence the outcome is at the front end. Lodging a complete file, answering requests quickly and timing medicals and clearances so they don't expire mid-assessment all shorten the wait. Where a program is capped, the queue reflects planning levels rather than your paperwork - so plan interim arrangements rather than waiting to make them.

Published times are historical medians rather than promises, so check the Department's current estimate for your subclass before you plan around a date.

Key points

  • Preparation time is controllable; assessment time is not
  • Complete evidence at lodgement is the main lever you hold
  • Time medicals and clearances so they do not expire before decision
  • Capped and queued pathways are driven by planning levels, not workload

How do you apply for the Business Innovation and Investment visa (subclass 188) step by step?

Direct answer

There are 7 stages, beginning with this: identify which stream matches your capital, ownership history and willingness to manage a business in Australia.

Order matters here. Several of these steps can't begin until an earlier one is finished, so a sensible sequence is worth more than working harder on any single stage:

  1. 1Identify which stream matches your capital, ownership history and willingness to manage a business in Australia
  2. 2Assess your net assets and business turnover against the current stream thresholds
  3. 3Research state and territory programs and identify jurisdictions whose criteria you can genuinely meet
  4. 4Prepare audited financial statements, valuations and source-of-funds evidence
  5. 5Apply for state or territory nomination and respond to any jurisdiction-specific request
  6. 6Lodge the subclass 188 visa application once nomination is approved
  7. 7After the grant, operate the business or hold the investment and meet the conditions for subclass 888

In practice, 5 mistakes account for most of the delay that could have been avoided:

  • Source-of-funds gaps that cannot be traced back to a lawful origin
  • Unaudited or internally inconsistent financial statements
  • Assuming one jurisdiction's criteria apply nationally
  • An undercapitalised or unrealistic business plan that cannot be delivered
  • Treating the provisional grant as the finish line and ignoring the subclass 888 conditions

Treat this as an evidence exercise rather than a paperwork exercise. Every claim needs to be something a case officer can verify, and planning the evidence before you fill in anything is what keeps the process short.

Key points

  • Identify which stream matches your capital, ownership history and willingness to manage a business in Australia
  • Assess your net assets and business turnover against the current stream thresholds
  • Research state and territory programs and identify jurisdictions whose criteria you can genuinely meet
  • Prepare audited financial statements, valuations and source-of-funds evidence

Fit test

Where this leaves you

Being clear about which category you fall into saves months of pursuing a pathway that is no longer open.

This page applies to you

  • You already hold a 188 visa and are working toward the 888
  • You have an active state nomination or invitation issued before closure
  • You are a high-net-worth individual exploring what replaced the program
  • You want to understand the 188 record for a pending or existing application

You need a different pathway

  • You are a business owner looking to enter the program now, it is closed to new EOIs
  • You are an internationally recognised high achiever. The National Innovation visa is the closer fit
  • You are a skilled business owner whose occupation is in demand. A state-nominated skilled visa may work
  • You want to invest without operating a business. Check current investor settings, which are under reform

Failure modes

Risks on the business migration pathway

These matter most to existing 188 holders working toward the 888, where the provisional period is the assessment window.

Assuming the program is still open

High impact

New EOIs closed from 1 July 2024. Applicants still preparing a 188 application are preparing for something they cannot lodge.

Fix: Confirm current program status before committing any capital or professional fees.

Business not meeting 888 activity tests

High impact

The permanent stage tests turnover, assets, employment or investment holding. A business that underperforms can miss the criterion.

Fix: Track the relevant metrics against the stream criteria from day one and seek advice well before the 888 is due.

Insufficient source-of-funds evidence

High impact

Legally obtained funds must be traceable. Unexplained capital is a common and serious problem.

Fix: Build a documented source-of-funds trail covering the full required period, with professional verification.

Residency days falling short

Moderate

Streams carry minimum Australian residence requirements, and frequent absence can breach them.

Fix: Track days in and out of Australia continuously against the requirement for your stream.

State nomination criteria shifting mid-program

Moderate

States adjusted priorities throughout the program's life, and could require more than the Commonwealth minimum.

Fix: Monitor the nominating state's current requirements throughout the provisional period.

Planning a pathway that no longer accepts applications

High impact

New EOIs closed from July 2024. Applicants continuing to prepare a 188 application are preparing for something they cannot lodge.

Fix: Confirm current program status with a registered agent before committing capital or professional fees.

Business plan that does not match the business operated

Moderate

The 888 is assessed against the activity the stream requires. A plan written for the application and then ignored leaves the record inconsistent.

Fix: Operate to the plan, or update the plan and keep the evidence aligned with what the business actually does.

Evidence

Evidence behind a business nomination

Business migration evidence is financial. The Department is testing whether the business is real, whether the turnover is verifiable, and whether the capital is lawfully obtained.

Evidence behind a business nomination
DocumentWhat it has to establishWhat strips it of weight
Audited financial statementsTurnover, profitability and net assets for the required years, verified independently.Management accounts that have not been audited, or figures that do not reconcile to tax records.
Business tax returns and activity statementsThat the business operated genuinely and reported its activity to the relevant authority.BAS and GST records that contradict the figures in the financial statements.
Ownership and structure documentsThat you own the required share of the business and control its management.Shareholdings held through structures that obscure the actual beneficial ownership.
Source-of-funds documentationThat the capital being committed was obtained lawfully and can be traced.Unexplained wealth, or transfers with no documented origin. A serious and common problem.
State nomination approvalThat a state or territory assessed your business case and agreed to nominate you.A nomination granted against criteria that have since changed, with no reassessment.
Business planWhat you intend to do in Australia and how it will generate the required activity.A generic plan that does not reflect the actual business you will operate.
Health and character documentsCompliance for you and included family members at both the provisional and permanent stages.Documents expiring between the 188 grant and the 888 application years later.

Where the pathway remains available to you, keep contemporaneous business records throughout the provisional period. The 888 is assessed on that record.

Straight answers

Short answers

Is the 188 visa still open?

No. New Expressions of Interest for the Business Innovation and Investment Program closed from 1 July 2024 pending reform. Existing holders continue toward the 888.

What replaced the business innovation visa?

Reform has redirected new interest toward the National Innovation visa (subclass 858) and state-specific business pathways. Confirm current settings with a registered agent.

Can I still apply for the 888?

Yes, if you already hold or held a 188 and meet the stream-specific business or investment activity requirements.

What were the 188 streams?

Business Innovation, Investor, Significant Investor and Entrepreneur, each with different capital, turnover and nomination requirements.

How long was the 188 valid?

Four years for the Business Innovation and Investor streams, and five years for Significant Investor and Entrepreneur.

Did the 188 require state nomination?

Yes for most streams. Nomination criteria varied by state and were often above the Commonwealth minimums.

What is the 888 visa?

The permanent stage of the business program, granted after the 188 holder meets the business activity, investment or residency requirements of their stream.

What should I do if I was planning a 188 application?

Book an assessment. Depending on your profile, the National Innovation visa, a state-nominated skilled visa or an employer-sponsored pathway may be the better route.

Can I still lodge an Expression of Interest for the 188?

No. New Expressions of Interest closed from 1 July 2024. If you are already in the program, your pathway to the 888 continues.

Is the Significant Investor stream still available?

Not to new applicants. The Significant Investor stream was one of the 188 streams and new EOIs are closed, so it is not an entry route at present.

What is the National Innovation visa?

The Subclass 858 is the permanent residence visa introduced in December 2024 that replaced the Global Talent program, aimed at internationally recognised individuals with a nominator.

Can business owners still migrate to Australia?

Yes, though usually through a different route. Depending on your profile, a state-nominated skilled visa or the National Innovation visa may be realistic. An assessment will identify which.

After grant

What the provisional period obliges you to do

For holders still in the program, the provisional years are the assessment window for the 888. Everything the permanent stage tests happens during this period.

Operate the business or hold the investment

Stream-specific activity is required throughout: turnover and employment for business streams, or holding complying investments for investor streams.

Meet residency requirements

Streams carry minimum Australian residence days. Track days in and out continuously rather than estimating at the end.

Keep audited accounts annually

Financial statements must be prepared each year and reconcile to tax records. Gaps are difficult to reconstruct later.

Maintain state nomination conditions

The nominating state may impose its own reporting or activity expectations. Monitor them for the whole provisional period.

Document business activity contemporaneously

Contracts, payroll, BAS and invoices kept as they arise are far stronger than records assembled at 888 time.

Plan the 888 early

The permanent application tests the whole provisional record. Review your position against the criteria well before you intend to lodge.

New Expressions of Interest are closed. This guidance applies to applicants already holding a 188 and working toward the 888.

Current settings

Where business migration stands now

Business migration is mid-reform. The single most important fact is that the main entry point is closed to new applications.

New Expressions of Interest closed
The Business Innovation and Investment Program stopped accepting new EOIs from 1 July 2024 pending reform.
Existing holders continue to the 888
Applicants already in the program can still meet their stream requirements and apply for permanent residence.
The National Innovation visa was introduced
The subclass 858 replaced the Global Talent program from December 2024 and is the main route now aimed at high-value individuals.
State programs continue to vary
State and territory business nomination criteria differ and change, and some states run their own arrangements alongside Commonwealth settings.
Charges index each 1 July
Where charges still apply to your circumstances, they move with annual indexation.

If you were planning a business innovation application, book an assessment. The realistic alternatives are the National Innovation visa and state-nominated skilled pathways.

Common Questions

Everything you need to know about the skilled migration process.

The Business Innovation and Investment Program (BIIP) was closed to new primary EOIs from 1 July 2024 for most streams. Existing 188 holders who received their visa before closure can continue their stay and apply for the permanent 888. If you are a new applicant seeking a business migration pathway, CMG maps alternative options including the National Innovation Visa (858).

Speak to an Agent

Yes. Existing 188 holders can apply for the permanent Subclass 888 after meeting their stream-specific activity requirements (operating a business, maintaining investments, etc.). The closure of the BIIP to new applicants does not affect existing 188 holders' pathway to the 888. CMG manages the full 188 → 888 transition.

Speak to an Agent

The National Innovation Visa (Subclass 858) replaced the high-calibre talent stream for exceptional achievers from December 2024. For established business owners and investors, limited alternative pathways exist. CMG provides a specific assessment based on your profile and capital.

Speak to an Agent

After meeting stream-specific activity requirements during the provisional period (operating a business in Australia (188A), maintaining complying investments (188C/188B), or executing an entrepreneur proposal (188E)) you apply for the permanent Subclass 888. CMG supports 188 holders throughout their provisional period to ensure compliance.

Speak to an Agent

AUD $5 million must be invested in complying investments for 4 years: at least 10% in eligible venture capital, at least 30% in eligible emerging companies, and the balance in managed funds or listed securities. State nomination is required. The 188C has no age limit and no English language requirement. CMG advises on the complying investment framework.

Speak to an Agent

For the Business Innovation stream (188A), you must generally operate your business in the nominating state during the provisional period. Requirements vary by stream and state. The Significant Investor stream (188C) typically requires spending time in Australia but has more flexibility on state of residence. CMG advises on your specific obligations.

Speak to an Agent

Yes. Your spouse or de facto partner and dependent children can be included as secondary applicants. They have the same visa conditions and work/study rights as the primary applicant. The financial requirements (business assets, investment capital) apply to the primary applicant only.

Speak to an Agent

The 188 is granted for 4 years (Business Innovation and Investor streams) or 5 years (Significant Investor and Entrepreneur streams). You can apply for the 888 once you have met your stream-specific activity requirements. CMG tracks your compliance throughout the provisional period and advises on the optimal timing for your 888 application.

Speak to an Agent

Requirements depend on the visa stream, your circumstances and the evidence available. Start with identity, eligibility, health, character and sponsor or nomination checks before preparing the application. Always confirm the current rule with the Department of Home Affairs before lodging.

Is the Subclass 188 still open for new applications?

The Business Innovation and Investment Program (BIIP) was closed to new primary EOIs from 1 July 2024 for most streams. Existing 188 holders who received their visa before closure can continue their stay and apply for the permanent 888. If you are a new applicant seeking a business migration pathway, CMG maps alternative options including the National Innovation Visa (858).
